笔者从文化、法律文化、法律文化的冲突与变迁以及经济法制度的法律文化土壤的思路进行研究,在理论分析的基础上,基于经济法形成与发展的特定背景与现实,阐释经济法以社会本位为价值取向、以权利与权力均衡为主旨、以平衡协调为内核、以人为终极关怀的内涵;经济法文化的路径考察由经济法文化演进与国家角色的变迁、经济法嬗变中的平衡协调精神、经济法文化孕育中的社会本位思潮、经济法文化熏陶下的经济法制度催生四个层面展开;经济法文化的特性表现为现代性和民族性,经济法文化与现代法治文明的关联涵盖两个方面,挖掘发扬传统法文化中的合理因素、警惕传统法文化中不合理因素的侵蚀;由于中西经济法文化的产生与发展存在一定的差异,西方经济法文化的发展表现为权利文化向权力文化的过渡转型,笔者以德国和美国经济法发展的历史性回顾与反思进行实证考察并结合西方的法社会学思潮研究与西方经济法文化的内在联系,同时围绕东方经济法文化进行探析,其表现形式是儒家文化,发展的过程表现为权力文化向权利文化的转移,其中中庸文化是中国经济法文化的底蕴。 |
